1. Agreement and Jurisdiction

  • These Terms apply to all customers globally. The legal jurisdiction for any disputes is Pakistan, along with the jurisdiction applicable to our server locations in Central Europe for hosted data and files.
  • By using our Services, you agree to be governed by Pakistani laws and accept the exclusive jurisdiction of Pakistani courts for any disputes.

2. Services Provided

2.1. Web APP Design and Development:

  • We deliver web design and development as per agreed scope.
  • We are not responsible for website maintenance after delivery unless you purchase ongoing maintenance services.
  • Any changes or maintenance after project completion will incur fees based on the required work.
  • We will not design, develop, or modify any website related to illegal activities.
  • Xecreators reserves the right to display links, screenshots, or URLs of websites we create as part of our portfolio.

2.2. Hosting Services:

  • We offer shared hosting, VPS, and VDS plans. Resource usage limits apply as per your plan.
  • We monitor resource consumption to ensure fair use and service stability. Excessive use may require account upgrades or suspension.

3. Customer Responsibilities

  • You are responsible for your content and ensuring compliance with all applicable laws and these Terms.
  • You must not use our Services for any illegal, harmful, or abusive purposes.
  • You must ensure you have the right to use all content hosted or processed through our Services, including respecting copyright laws and not using pirated or unauthorized content.
  • You are responsible for timely payment of all fees and charges.

4. Prohibited Uses

You agree not to use our Services for:

  • Hosting pornography or sexually explicit content.
  • Gambling or betting platforms.
  • Content promoting illegal activities or organizations, especially violating laws of Pakistan or server jurisdictions.
  • Infringing third-party copyrights or intellectual property rights.
  • Conducting attacks like DoS, port scanning, phishing, botnets, or other malicious activities.
  • Running open proxies, TOR exit nodes, or unauthorized VPN/proxy services.
  • Mining cryptocurrencies on shared hosting (allowed on VDS with conditions).
  • Hosting piracy, illegal downloads, or pirated software.
  • Any activity that compromises server performance or security.

5. Account Suspension and Termination

  • We reserve the right to suspend or terminate accounts for violation of these Terms or excessive resource use, with or without notice.
  • Upon termination, customers must remove domain host registrations promptly. Failure to do so may result in administrative fees.
  • No refunds will be issued if termination is due to customer violation of Terms.

6. Payment, Refunds, and Chargebacks

  • All payments must be made on time to avoid service interruption.
  • Billing disputes or chargebacks may lead to immediate suspension or termination without refund.
  • Xecreators reserves the right to change pricing and fees with notice.

7. Support

  • Support is provided via ticket system in our Client Area and generally processed in order received.
  • Support is offered in English and Urdu. Profanity or abusive language will not be tolerated and may lead to suspension.
  • Support for shared hosting covers hosting environment issues, not individual website/script problems.

8. Limitation of Liability and Disclaimer

  • Services are provided “as is” and “as available” without warranties.
  • Xecreators is not liable for any damages arising from use of the Services, including data loss or downtime.
  • Customers are responsible for backups and data security.
  • Some jurisdictions do not allow certain exclusions of liability, so these may not apply to you fully.

9. Changes to Terms

  • We reserve the right to modify these Terms at any time. Continued use of Services constitutes acceptance of changes.
  • Customers are responsible for regularly reviewing the Terms.
